What IS a Stipulation of Settlement?
A Stipulation of Settlement is a formal agreement between two parties. Typically, a divorce stipulation is a lengthy formal agreement that shows the court what the parties agree to regarding divorce issues such as child support, custody, visitation, health insurance for children, division of marital property, division of marital debts, and all other issues that arise out of a divorce.
Why is the court asking me for a Stipulation of Settlement?
We've seen over the last 10 years that the New York State Supreme Court will ask for a Stipulation of Settlement when the court is either unsure about what the parties are trying to accomplish, or if the parties are trying to do something that can only be done by written agreement. One common example of this is when the parties agree to pay child support that does not conform with the Child Support Standards Act (CSSA). Another common example is when the parties have marital property and or debts to divide.
